Operational-search description of crimes related to illegal reproduction and distribution of software

Abstract

In the article, on the basis of the existing operational-search technology approaches provided operative-search characteristics of crimes related to the illegal reproduction and distribution of computer programs. An analysis of scientific sources suggests that today the issue of the operational and investigative characterization of crimes related to illicit reproduction and distribution of computer programs is still insufficiently studied. It has been established that the operative-search characteristics of crimes related to illegal reproduction and distribution of computer programs can be provided in the process of disclosing the following components: the criminal-law component (the object of a criminal encroachment, the object, the objective side, the sub- object, subjective side); criminological component (state and dynamics, signs of a crime, person of the offender, determinants); Forensic component (typical ways of committing a crime, characteristics of the victim, traces of the crime). The results of the study of criminal proceedings for crimes related to the illegal reproduction and distribution of computer programs showed that in the vast majority of cases, these crimes were committed by men (72%), 79% of criminals had higher education, most of the perpetrators were not previously convicted (92 %) Crimes of this category were usually committed by criminals under the age of 35 (67%). It has been established that in the vast majority of cases analyzed victims of crimes related to illegal reproduction and distribution of computer programs are recognized by the authors of software products or their rights holders. One of the prerequisites for a high-quality operative and investigative counteraction to crimes connected with illegal reproduction and distribution of computer programs should be the consideration of the components of the operational-search character of this kind of crimes in the process of choosing tactics for the implementation of measures aimed at their detection and documentation.
