Abstract
The article analyzes well-known practices of alternative dispute resolution as a separate social and legal institution. It is argued that the existence of common, fundamental ideas allows us to combine alternative methods of resolving disputes into a separate institute. The content and essence of these ideas are analyzed, their rethinking is done in view of Ukrainian realities.
