Особливості організації й тактики огляду місця події при розслідуванні незаконної порубки лісу

Abstract
На підставі аналізу наукової літератури та практики органів досудового слідства розглянуто особливості організації й тактики проведення огляду місця події при розслідуванні незаконної порубки лісу. Розкрито зміст, завдання та значення цієї слідчої (розшукової) дії. З урахуванням особливостей досліджуваного злочину визначено комплекс дій слідчого на підготовчому, робочому та заключному етапах проведення огляду. Надано практичні рекомендації з оптимізації процесу виявлення та вилучення типових слідів злочину. The article is devoted to the analysis of the organization and tactics of inspecting the scene of an incident in the investigation of illegal logging. Taking into account the specifics of the crime under investigation, the content, tasks and significance of the site inspection were analyzed, the investigator's complex of actions at the preparatory, working and final stages of conducting this investigative (research) action, as well as fixing his progress and results, was determined. It is determined that the preparatory stage covers a set of activities related to the investigator's clarification of information regarding the nature and circumstances of the event, the conditions and the situation of the future inspection; the definition of participants in investigative (search) actions; checking the readiness of the investigative suitcase and ensuring the availability of cartographic materials. The next, working stage, is proposed to be divided into two stages: general (including the definition of inspection boundaries and landmarks for attachment to the terrain, photographing) and detailed (includes the identification, study, recording and removal of traces identified on the site of illegal logging). At the final stage of the inspection of the place of illegal logging, a protocol is made for the inspection of the scene of the incident, which includes the following information: time, place of the illegal logging; name of the forest area, district, quarter number; boundaries of cutting and its area; information about participants in investigative (investigative) actions; methods and methods of cutting; territory and categories of forests, the number and breeds of illegally cut trees and so on. The article focuses on the need to draw up a scheme of the scene with mandatory localization of places to identify traces of crime, the removal of relevant samples, the identification of individuals and vehicles. The issues of detection and seizure of traces of a crime, in particular: traces related to the crime subject, are analyzed in detail; traces of shoes and vehicles; biological traces of a person (blood, saliva, sweat, urine and the like); traces of guns and means of committing a crime. The article also provides recommendations aimed at improving the activities to investigate the material situation of the scene.
