Abstract
The article is devoted to the study of one of the types of probation provided for in the legislation of the Republic of Kazakhstan – the sentencing type of probation. The author believes that this type of probation may be attributed to the so-called "classical" type of probation, because the sentencing probation originally represented the probation institute as a whole was the only type of probation from which, subsequently, probation originated in Kazakhstan. The article provides arguments on the basis of which the author believes that the sentencing probation is a "classical", generally accepted type of probation, based on comparison with other types of it, provided for by the penitentiary legislation of the Republic of Kazakhstan. In addition, the author's opinion is expressed on the need to classify such a criminal-legal institution as a delay in serving a sentence, to a sentencing probation based on an analysis of the legal nature of the delay.
