OWNERSHIP: PROBLEMS OF THE TRIAD

Abstract
The article contains a theoretical study of the contents of the property right. The analysis of the doctrine of civil law, jurisprudence and practice of the European Court of Human Rights is carried out in order to reveal the modern content of the property right. The essence of the triad of property rights is revealed. It is substantiated that for a long time no real relations existed with the doctrine of civil law, which certainly did not contribute to the development of legal thought and the terminology of the content of property rights. It is argued that the existence of a limited design of property right now in Ukraine causes an artificial freeze in the development of legal relations of property and does not contribute to the development of the European integration prospects of our country.
