Abstract

From the decisions adopted in fourteen executive decrees, a ministerial circular, two constitutional rulings on the advancement of taxes, a sentence that declares the budgetary guidelines applied to higher education institutions unconstitutional and the budget execution report for the year 2020, the behavior of the State vis-à-vis public finances is analyzed. The objective of this study is to reveal that the State failed to observe the need to implement a contingency plan, suspend the fiscal goals or objectives set for the 2020 fiscal year, activate escape clauses and attend to the urgency, imminence, necessity and promptness in the application of human rights protection parameters in extraordinary times. The methodology used is the critical analysis of the law with a focus on the decisions of the State that had an economic impact in 2020, based on the normative foresight that governs the Constitution of Ecuador, as well as the international recommendations and standards for its materialization. The comprehensive conclusion of the study is that the declarations of different states of exception and their renewal did not support the concrete and necessary economic reality to finance two unforeseen events that occupied the attention of the State, such as: the COVID-19 pandemic and the prison crisis, deepening the fiscal crisis and transferring the commitment to finance these crises to future generations.
