Payment of penalty among consequences in law of breach of a contract

Abstract
The article is devoted to the payment of penalty as consequences in law of breach of the contractual commit- ment. It is identified by the author varieties of penalty depending on penalty subject, method of its calculation and character of secured by it commitment taking into ac- count the contradictory provisions of the Civil and Com- mercial Codes of Ukraine therein. A comparison of such consequences of breach of the contractual commitment as payment of penalty and compensation of damages has been conducted. The penal and evaluation theory of penal- ty has been considered.
