PECULIARITIES OF ACQUISITION AND DISPOSAL OF INTELLECTUAL PROPERTY RIGHTS BY THE STATE

Abstract
The article provides a detailed analysis of legislation of Ukraine that regulates the distribution of intellectual property rights for research results, carried out by the state budget. It was established that existing legal provisions do not provide a clear understanding of whom the property rights belong to, and who will be responsible for their implementation, particularly, in the field of secret intellectual property creation. It was proved that legislation of Ukraine sets the additional restrictions for property rights of research performer that is contrary to the TRIPS Agreement and other rules of international law on intellectual property.
