personality of offender - civil servant in the system of empirical studies to prevent abuse of power or position

Abstract

The personal characteristics of an offender-civil servant who commit abuse of power or office are outlined. Based on the study of law practice, the criminological portrait of a person of such a criminal is formulated. In particular, the following typical features of the person of the offender are established: 1) in today's official crime, in particular the abuse of power or office, actively engaged in persons of mature age (30-50 years) who are dissatisfied mainly with the salary of a civil servant; 2) the proportion of the socially dissatisfied male population grows, whose representatives hold positions for their own enrichment; 3) there is a very high level of education of criminals, which is explained by the qualification requirements for hiring a civil servant. The emphasis is placed on the fact that one of the guarantees of the successful functioning of the state and civil society is the creation of proper conditions for the effective functioning of the state apparatus, the apparatus of local self-government bodies and enterprises, institutions and organizations, regardless of the form of ownership. The effectiveness of such activities in Ukraine at the present stage is significantly reduced under the influence of negative political, economic, legal and other changes, as well as a high level of crime. A significant link among these factors is the abuse of office by the authorities or office they provide. It is proved that the criminological portrait of a civil servant's offender can be seen as follows: a male person aged 30 to 50 years with a complete higher education, which has a clear anti-social setting, understands the post solely as a means of illicit enrichment. It was stated that a promising direction of further research is the development of scientifically grounded measures to prevent abuse of power or official position committed by civil servants.
