Political factors of criminality in the sphere of subsoil use in Ukraine

Abstract
The article is devoted to the criminogenic factors, which having a social and political origin and has grouped into three functional blocks: endopolitical factors of crime in the sphere of subsoil use; political crime as a metasystem factor of criminogenic self-determination; exopolitical factors of political crime and criminal subsoil use. Among the latter, such as oligarchization, the criminalization of politics, the preservation of the regime of managed democracy are highlighted, described and explained. The criminal role of the lack of political will on the proper legal support of the environmental sector of criminal preventive activities and the protection of the subsoil was noted. It proves that application of moratorium on auditing business entities had an adverse impact on the ascertaining facts of illegal utilization of mineral resources of national importance, which is virtually displayed in statistics of the crime analyzed. Application of such moratorium on auditing subjects of special subsoil use by the Public Service of Geology and Subsoil of Ukraine resulted in high latency and logical intensification in self-replication of criminal subsoil use. Special attention is paid to drawbacks in administration of law enforcement agencies: 1) decrease of professionalism in organization and execution of investigative activities of the National police; 2) the lack of succession in maintaining operational control over territories, decrease in quantity and quality of links with confidential informants; 3) decrease in the rate of organized crime detection and prevention; 4) the lack of service priorities in detection and prevention of crime in the sphere of subsoil use. At the present moment there is no specially dedicated activity for detecting crimes in the sphere of subsoil use in the units of the Department economic protection of the National Police, neither professionals assigned for such activities; 5) termination of special environmental protection activity of prosecutor’s offices; 6) the lack of regulation in conducting gemological examination by the Expertise service of the Ministry of Internal Affairs that was a direct consequence of elimination of specialized organized crime units of the Ministry of Internal Affairs in 2015.
