Positivist Legal Understanding and Evaluative Concepts of Criminal Law

Abstract
Current legislative trend associated with the widespread replacement of the evaluative criminal law concepts and its replacement with the normative concepts have been analyzed in the article. Certain shortcomings of such approach are revealed and its inexpediency is justified. It is proposed to return or save the traditional evaluative status of some certain concepts of criminal law in order to provide the subject of criminal law regulation with the necessary flexibility.
