ПРАВОВЕ РЕГУЛЮВАННЯ АНТИДЕМПІНГОВОГО МИТА В УКРАЇНІ

Abstract
The antidumping duty is a type of customs duty applicable in Ukraine. The general features of antidumping duty are: the tax nature, the obligation and the conditionality of payment by the fact of moving goods across the border. The special features of antidumping duty are: the protective nature of the economic interests of the state and national commodity producers through the regulation of imports; regulation of goods that are object to dumping; determination of a separate legal act of the procedure of application and establishment on the basis of the investigation conducted. The functions of the antidumping duty are: fiscal, regulatory, protective, control and integrative. The mechanism of protection of the national producer from dumping of imports from other countries established in the Law of Ukraine “On the Protection of the National Producer against Dumped Imports” dated December 22, 1998, Ref.No. 330-XIV. The law in force today remained practically unchanged since its adoption. Therefore, the Ministry of Economic Development and Trade in Ukraine has developed a new version of the Antidumping Law, which will become a step towards improving the legal regulation of antidumping duty in Ukraine. Taking into account the aspiration of Ukraine accession to the European Union, it became necessary to study antidumping experience of foreign countries and the expediency of its application. An agreement about the association of Ukraine and EU confirmed possibility of application in mutual trade of anti-dumping measures on the basis of century of VI of the General agreement from tariffs and trade. Exactly the signed Agreement allows to the Ukrainian producers to initiate corresponding investigations in case of unfair competition from the side of producers of EU that harms to the national production. International practice also envisages the observance of principle of transparency of anti-dumping investigation by opening of settling, unconfidential versions of reports, in accordance with that anti-dumping duties are used, by realization of consultations with parties concerned.
