ПРИНЦИПИ ГНУЧКОСТІ ПРОЦУСУАЛЬНОЇ ФОРМИВ ДИСПОЗИТИВНОМУ ПРОЦЕСІ: ЗАГАЛЬНОТЕОРЕТИЧНІ ПІДХОДИ

Abstract

It is substantiated that any legal process, especially one that starts at the initiative of an interested subject, can exist and develop only within the form fixed in the law, that is, within certain rules establishing the procedure and activities of all participants in the legal proceedings. It is proved that the civil procedural form is by its nature the maximum universality, based primarily on the fact that civil jurisdiction is of a general nature, while administrative and economic jurisdiction are special with respect to the first. The latest codification of procedural legislation is based on the beginnings of maximum unification of procedural forms and procedural procedures, with the exception of specifics of reviewing certain categories of cases (separate proceedings in civil proceedings, consideration of certain urgent cases in administrative proceedings, consideration of bankruptcy cases in economic cases, etc.). Therefore, if we consider the claim procedure for the consideration of court cases in discretionary processes, then the procedural form, built on the principle of universality, will be the general theoretical basis. It is concluded that the modern law is increasingly lagging behind the rapidly changing public relations, which in turn leads to the emergence of gaps in it, which is characteristic of the acts of Ukrainian procedural legislation set out in the new edition. It is determined that the flexibility of the procedural form is enshrined in the law of the possibility of subjects of the judicial process to influence the choice of optimal procedural actions due to the circumstances of a particular civil case and aimed at protecting the rights and legal interests of the participants in the judicial process. It is substantiated that it is the flexibility of the procedural form of the dispositive process (economic, civil, administrative) as one of its basic principles, combined with a reasonable application of judicial discretion, will allow to more effectively applying the existing rules of civil procedure, adapting them to the situation.
