Principles of realization of citizens’ right to self-defense

Abstract
The article deals with clarification of the essence and content of the principles of realization of the right of citizens to self-defense, determination of their place in the system of constitutional principles of ensuring the rights and freedoms of man and citizen, as well as the correlation with the corresponding directions and tasks. The state of normative consolidation of the principles of realization of the right of citizens to self-defense has been analyzed and their author's list is proposed. In particular, the principles of realization of the right of citizens to self-defense are proposed to consider the principles: the rule of law, legality, voluntariness, the validity of self-defense, the presumption of the legitimacy of human rights to grant him rights, freedoms and legitimate interests, proportionality of violations, reality violations, reasonable and objective assessment of necessity, the significance and effectiveness of self-defense, the absence of excessive limits of self-defense, legal liability for deviations from the order and rules of self-defense. It is established that the principles of realizing the right of citizens to self-defense are a system in which they are interrelated and interdependent. Therefore, a violation of one of them may lead to a change in others. It is in these principles that the content of the legal institution of self-defense is clearly manifested, since they determine the most significant features, qualitative properties of legal regulation of the right of a citizen to self-defense. The success of the implementation of the right of citizens to self-defense is achieved through the consistent application of both the whole system of principles and each of them separately.
