Abstract

A prison community as a whole reflects a society. Indeed, among prisoners there can be adults and children, men and women, representatives of all social groups and professions, intellectually developed and uneducated, mentally healthy and sick. They are united by one thing - they are deprived of their liberty. While in prison cells these people become the same and are called “contingent”. The term “prisonization” is widely spread in science, i.e. imprisonment of normal life, spreading traditions and culture of the prison environment. Prisonization, in fact, is one of the mechanisms of formation of prison as a total social institution. According to the court statistics in Ukraine there gradually formed a broad criminal environment, based on the people sentenced to imprisonment, recidivists and members of organized criminal groups. It is this category of criminals that creates a special culture that is called criminal or prison subculture. The criminal environment expands; the number of people who received prison school is growing. It is generally accepted that in the present conditions imprisonment is aimed at correcting behavior - rehabilitation of criminals and turning them into law-abiding citizens. However, since the second half of the XX century there has been a crisis of punishment because prison is a school for criminal professionalism, but not the place of correcting. The question is why the prison subculture attracts people so much. There can be called some reasons: the need for self-expression, search of oneself, thieves’ romance. The main factor contributing to crime in prison is the so-called asocial subculture, which is a system of values, norms, traditions governing the behavior of prisoners and their relationship with each other and other people. For confinement institutions asocial subculture is a natural and objective phenomenon. By its type, the community of the convicted is a closed society; by the nature of the social structure is a clan and caste society. An important means of reducing the impact of prison subculture is the use of punishment not connected with deprivation of liberty. In the system of criminal justice there is a possibility to apply different penalties with regard to their social danger. However, in practice it is implemented differently. Probation is among the alternatives to punishment of imprisonment. On 05.02.2015 the law “On probation” was adopted in Ukraine. The criminal situation in Ukraine requires finding and using effective enforcement measures in combating crime. Ensuring human rights, reduction of imprisonment in the structure of punishment are the main activities today.
