ПРОБЛЕМА ФОРМИ ДЕРЖАВИ ТА РОЗПОДІЛУ ВЛАДИ У ПОЛІТОЛОГІЧНІЙ КОНЦЕПЦІЇ В’ЯЧЕСЛАВА ЛИПИНСЬКОГО

Abstract
Досліджено погляди В’ячеслава Липинського щодо проблематики форми держави та розподілу влади у контексті української політичної думки консервативного спрямування. З’ясовано типологію державно-політичного ладу, запропоновану мислителем. Охарактеризовано концепцію «правової трудової монархії» з класократичною організацією суспільства та спосіб функціонування інститутів влади у ній. The article deals with the scientific views of Vyacheslav Lypynsky, a well-known thinker, an ideologueof Ukrainian conservatism and one of the national political science founders. The activist’s politological concept is analyzed in connection with forms of government, political system and authority distribution issues. It is stated that the philosopher determines three forms of political system such as a democracy with a republic, an ochlocracy with dictatorship and klasokratia (classocracy) with a legal monarchy.The article confirms just a third form of political system to be recognized by V. Lypynsky as themost favorable one for the Ukrainians under existing conditions of political development and national identification. The scientist showed himself as ahigh-principled supporter of monarchy in the traditional for Ukrainian people form, known as Hetmanate. According to V. Lypynsky Ukrainian «legal monarchy» was based on the principals of constitutionalism and authority distribution into three branches such as Hetman (head of state) who personifies and deputizes the state being a representative of an aristocraticdynasty that impersonates the supreme power as well as prestige; Hetman Board being an executive branch that stands at the head of internal and external policies (members of the Board are nominated by a hetman and agreed with Jury trial); Legislative Body (supposed to formed of two chambers: territorial to represent the interests of Ukrainian regions and labor to stand for concerns of organizations, workers and trade unions that is representation of klasokratia form where the best delegates of peasant, working, merchant and other classes are chosen to); Jury Trial is the highest judicial authority fulfilling supervisory functions for Hetman. The author clarified that despite the denial of party representation (it was replaced by delegates ofklasokratia), V. Lypynsky was a supporter of political pluralism, democratic principles of elections, personal immunity, private property and other symbols of democracy.
