PROBLEMATIC ISSUES OF APPEALING THE DECISIONS OF THE ANTIMONOPOLY COMMITTEE ORGANS IN THE CASES OF PROTECTION OF ECONOMIC COMPETITION

Abstract
The Article considers legal practice of resolving disputes in which the Antimonopoly Committee of Ukraine takes place, and disputes regarding application of the Competition legislation. It is stated that a declarant, defendant or third person may appeal to the Commercial Court of Ukraine a decision as well as any act of organs and authorized persons of the Antimonopoly Committee, issued according to their competence. The Court may recognize the decision invalid fully or partially, but may not oblige the proper organ to accept a new decision.
