Abstract
The article deals with the problem of absence in proceedings materials of a journal of court session or a technical information medium, which holds court proceedings in a trial court, as an essential violation of requirements of the criminal procedural law. Additionally the need for a broad interpretation of this ground was proved. It was substantiated that when it comes to recording of court proceedings, a mechanism can not be applied when non-application of technical means for recording criminal proceedings in cases, if it is mandatory, does not entail the invalidity of relevant procedural actions and results of such actions if the parties do not object to the recognition of such action and the results of its implementation as valid.
