Problems of creation of local (municipal) police in Ukraine

Abstract
The article highlights the problematic issues of creating a local (municipal) police in Ukraine. It is concluded that the processes of creating a local (municipal) police should be preceded by a decision on issues related to the legal regulation of its status, with a precise definition of tasks, functions, and the division of powers with the central authorities of the National Police. The feasibility of funding local (municipal) police is justified by local self-government bodies. In the course of the reform of the local self-government and territorial organization of the government, reforms in the system of organs of the Ministry of Internal Affairs of Ukraine, the implementation of its own model of management at the regional level, taking into account the experience of the countries of the European continent, is essential for achieving a significant level of public policy and security performance at the local level, providing citizens with the required number and quality of police services. The current practice of the police affairs shows that the decisive condition for ensuring proper public order and public security in a particular territory is, first of all, the consideration of local characteristics, the clear organization and management of forces and means, the possibility of obtaining timely and reliable information about the committed offenses and the prompt response on her. With the commencement of democratization of society, with the depoliticization of the Ministry of Internal Affairs system, decentralization processes, which involve the granting of greater rights to local authorities and self-government in a number of regions of Ukraine, is becoming a topical issue of creating local police units that should be held at the expense of local budgets. The emergence of such formations will allow us to speak about the real provision of the right of territorial communities to self-government, their ability to independently solve the issues of ensuring the security of citizens at the local level. This, in turn, will allow all necessary steps to be taken to maintain proper public order in its territory Consequently, in today’s conditions of state-building and decentralization, the problem of the creation of a local (municipal) police is rather topical and requires the fastest solution. The priority model of the local (municipal) police should be its creation on the basis of police units of preventive activities. In addition, the processes of creating a local (municipal) police must be preceded by a solution to the issues of regulatory legal regulation of its status, with a clear outline of tasks, functions, division of powers with the central authorities of the National Police and the ways of financing. When choosing a model for building a local (municipal) police, one must also resolve the issue of the subject, which must establish the size and structure of the local police. The basis for this choice of system and organizational structure of the local police should be the size of the population, its density, size and features of the territory of local education, the ability of the local self-government body to finance it. When determining the organizational structure of the local police, the geographical features of the service area should be taken into account, and they may be different.
