Progressive punishment execution system under state criminal penitentiary system reformation in Ukraine

Abstract
This article is devoted to problems of legal regulation and practical implementation of progressive penal system. The project deals with problems that arise during the implementation of progressive penal system. Today the progressive penal system is not regulated by the Ukrainian penal law and has no clear definition, but only indirectly derives some of its rules, which causes difficulties in its perception. There characterized the existing approaches in national and international practice to defining the progressive system of execution of criminal penalties, the main features of this system, there considered possible directions of improvement of the national penal system based on the progressive international experience in the preparation of a conceptual plan for reform of the State Penitentiary Service of Ukraine. There analyzed the statement of the proclaimed in 2016 by the Ministry of Justice of Ukraine reform of the State Penitentiary Service, which aims to move away from the Soviet system of prisons to the European system. One of the principles, established in international standards is to ensure the organizational process of execution of punishments based on plans that include elements of a progressive system. Therefore, a progressive system of execution of punishments should find its reflection in the transformation of the State Penitentiary Service of Ukraine, as it is the only way to ensure the introduction of advanced European standards.
