PROSPECTS FOR THE REFORM OF DECENTRALIZATION OF PUBLIC AUTHORITY IN UKRAINE THROUGH THE PRISM OF STATE-BUILDING PRACTICE: THE THEORETICAL AND LEGAL ASPECT

Abstract

The research paper deals with the search for ways to increase the efficiency of decentralization of public authority in Ukraine and to develop proposals for eliminating existing problems at the current stage of its implementation. The essence and different forms of decentralization of public authority are revealed. The features of political, administrative, budgetary and economic decentralization are determined. The content of territorial, functional and subject decentralization has been observed. The analysis of the assessment results of the financial capacity of the united territorial communities as an indicator of the effectiveness of the decentralization policy is carried out. Trends in decentralization processes in Ukraine covered almost all areas of state-power relations and relations in the system of local self-government. The reform of the decentralization of public power has caused systemic shifts in the architecture of relations between central executive authorities, local self-government bodies, and state executive bodies. Decentralization at the regional level is perceived not only as an extension of the capacity of public authorities to carry out their own functions through the redistribution of material resources but also as a freedom in the political plane and reducing the level of responsibility to the central authorities. Despite the fact that the decentralization of public authority is an objective need to democratize social processes and build civil society and a law-governed state, it is quite difficult and has a lot of problems in some aspects. In particular, it is about the processes of the administrative-territorial reform of the formation of united territorial communities, the financial and administrative capacity of which will be much higher than in some communities before such an association. Decentralization in some regions is taking place due to the strong opposition of local regional elites who are trying to maintain the existing balance of power and the distribution of spheres of influence. Another major problem of the reform of public authority is the complexity of determining the mechanism of the relationship between local government and state authorities at regional or district levels. The effectiveness of the implementation of state-management relations depends precisely on how clearly the powers of certain subjects of public authority will be defined. All this determines the urgency of the further continuation of the reform process of public authority in the direction of its decentralization.
