PUBLIC REGISTRATIONOF PROPERTY RIGHTS BY NOTARIESBY THE TRANSFER OF THE RIGHTS OF OWNERSHIP TO THE SUBJECT OF MORTGAGE

Abstract
The article deals with peculiarities of implementation of state registration of property rights by notaries on the basis of reservation on satisfaction of the requirements of mortgagee by transferring the right of ownership to the subject of mortgage in order to fulfill the main obligation. Approaches to understanding concepts of mortgage and mortgage agreement are analyzed. It’s stated that the concept of a mortgage agreement is not consolidated at legislative level. The author’s definition of the mortgage agreement is submitted. The reasons for satisfying the requirements of mortgagee by appeal of stagnation on the subject of mortgage are determined. The peculiarities of the procedure of state registration of property rights by notaries by transferring the right of ownership to the subject of mortgage are investigated.
