RATIONE LOCI JURISDICTION OF HYBRID CRIMINAL COURTS

Abstract
The article highlights the issue of territorial jurisdiction of the hybrid criminal courts. It is determined how the founding documents of such courts describe their territorial jurisdiction. Attention is paid to the fact that the Special Court for Sierra Leone was forced to objectively interpret the principle of territoriality in order to establish its own jurisdiction on particular cases. It further specified the unique practice of the principle of universality enshrinement in the statute of the hybrid court for East Timor. The article proposes an approach, according to which the principle of universality is acceptable for hybrid courts in Bosnia and Herzegovina and Kosovo.
