Realization of citizens’ political rights through online (electronic) consultations

Abstract
The article determines the legal nature of the online (electronic) consultation and the possibilities of this instrument to develop the e-democracy. It reveals the concept of online consultation, main tasks of such tools of e-governance and obstacles that arise with using it. Online (electronic) consultation is one of the constitutionally-legal forms of the political activity of citizens by its legal nature. This political activity of citizens consists of opinions about one or more specific topics using information and communication technologies in a real-time. It helps to make a compromise decision for government. The main purpose of these consultations is to make sure prompt collection of proposals and comments from ordinary citizens to produce optimal power solutions. Online (electronic) consultations have been established in the legal system of Ukraine in recent years. For example, «The order of holding consultations with the public on formulation and implementation of State policy» and «The concept of the development of e-democracy in Ukraine and the action plan for its implementation» are approved by the Cabinet of Ministers of Ukraine. Online (electronic) consultations have a huge positive potential as one of the many initiatives, which help to democratize our joint life. Also, it contributes to the spread of civil information and encouraging the active participation of all citizens in the public sphere. Involvement of the community to realize their political rights through the online (electronic) consultation is a perspective tool for overcoming the democratic deficit between citizens and the State. International experience shows a lot of examples of successful involvement of citizens in decision-making power. However, even though we have the existing law framework, the remain questions is about the active participation of the citizens in online (electronic) discussions. It is extremely important for the effective implementation of this instrument to have the activity of the civil society, which is interested in the realization of their own political rights, overcoming the deficit of democracy and the development of e-democracy.
