Регулювання cурогатного материнства в українському законодавстві / Regulation of Surrogate Motherhood in Ukrainian Legislation

Abstract

The article considers the concept of suraganova maternity in accordance with legislation of Ukraine. The attitude to surrogacy in different countries of the world is analyzed, namely whether this phenomenon is allowed, whether there is a penalty for the commission of procedures in relation to surrogacy. The existence of the surrogacy contract and its terms are investigated and the main reasons for the absence of this type of contract in Ukrainian legislation are revealed. The attitude to surrogacy on the part of morality and ethics is determined. Specific recommendations aimed at improving the legislative regulation of surrogacy have been developed as well as important issues to pay attention to. Nowadays the problem of reproductive health and reproductive rights has become very important. Surrogate motherhood is a new phenomenon for Ukrainian legislation and has not yet found its place in the general system of law. The most important problem of insufficient legal regulation relations arising in connection with the use of surrogate motherhood is the absence of a legally established definition of surrogate motherhood. Moreover, there is no clear definition of the subjects of these relations, rights and obligations of the parties to the contract of surrogacy motherhood, determination of consequences in case of non-fulfillment of conditions as well as the lack of protection of the rights and legitimate interests of a child born of a surrogate mother. In the current Civil Code of Ukraine there are no clearly defined rules regarding the content of the surrogate motherhood treaty, its legal effects and the procedure of conclusion, modification and termination.
