Abstract

The case-law of the European Union Court of Justice can contribute to the empowerment of individuals in the preliminary ruling proceedings by stricter rules of obligatory submission of initial appeal by the national court, and clarification of the rules of state liability for breach of the obligation to initiate such a procedure. An analysis carried out in the article focuses on issues related to indirect access of citizens of the European Union to the EU Court, the impact of the proceedings on the legal position of the entity.
