Rozstrzyganie polubowne sporów zawiązanych z rejestracją domen internetowych – część II

Abstract

Today, Internet domain names are a particularly important part of the economic life of many entities. Good Internet address makes it easy to find the necessary site in the network, which may translate into profits for a domain holder from the sale of goods or services. You can argue that in today's world it is very difficult to function without having your own Internet domain. More and more companies decide to register their Internet address, because in the eyes of potential customers the company basically does not exist if it is not present on the Internet, just as often jokingly said that if a person does not have an account on a social network, they actually do not exist. In practice, operation of Internet domains can involve a lot of problems and difficulties. Obtaining an optimal network address may be a difficult situation when someone else bears the same name, or the company on the market operates with the same or similar name, having legalized law as trademarks. For many, business domain is now a good source of income. Then, conflicts arise when someone becomes the owner of the address to the site of the name which is the same or similar to the name of the entrepreneur holding a trademark to its name. As shown in the last decade, there are many situations in which different actors have rights to Internet addresses with similar names. Often interventions are necessary from the judicial authorities, especially when an amicable solution to the dispute is not possible. The article concerns the settlement of arbitration disputes relating to the registration of Internet domain names under Polish law based on theoretical data and information on conducted litigation in the Court of Arbitration for Internet Domains at the Polish Chamber of Information Technology and Telecommunications. Both types of infringements and their legal consequences of disputes concerning Internet domain names are discussed here.
