Scope, forms of application and legal character of subsidy contract

Abstract
This article presents legal issues connected with the relation between the state and beneficiaries of earmarked subsidy out of the state budget transferred for realization of public duty, especially between the state and local government units, as well as the meaning and the role of subsidy contract in these relations. Provisions of the Public Finance Act referring to the conditions of awarding and reimbursement of the subsidy and, on the other hand, the right to regulate some of the rules in a contract as an institution of private law are discussed in the context of public character of the funds from subsidies. Additionally, common problems with the application of the provisions of law have been reviewed in the above-mentioned context.
