SOME ASPECTS ON THE PRESENT ISSUE REGARDING THE PROTECTION AND GUARANTEE OF THE FREEDOM OF EXPRESSION AND OF THE RIGHT TO A PRIVATE AND FAMILY LIFE

Abstract
The freedom of expression and the right to a private life represent humans’ evolutionary rights. The analysis of their protection demands a series of multiple approaches from different scientific perspective, due to their social importance. Understanding the manner in which all states value their chance in adopting a Security Strategy in a global context, according to international law provisions, represents an essential progress condition and the only way in which democracy, fundamental rights and freedoms are promoted. All these important subjects also demand a responsible research (the regulation and the judicial treatment offered in a given society have direct consequences on the entire humans’ existence). The issuing of a protection and a guarantee – due to the interference of these rights – represents a maximum responsibility subject, including the establishment of general and specific limits for each of these rights (besides the reciprocal limitations brought on each other), obviously, by respecting this “just equilibrium” between the two rights. Thus, besides the use of concepts, theories, paradigms and methodologies used in a judicial analysis regarding the protection of the rights mentioned and of human rights in general, other approaches, of a philosophic-political, sociological inspiration etc. are also needed, especially when taking into consideration tendencies manifested at a global level.
