SOME ISSUES OF THE ADMINISTRATIVE AND LEGAL STATUS OF THE POLICE BODIES OF THE LATVIAN REPUBLIC

Abstract

Problem setting. The article deals with some actual issues of the administrative and legal status of police authorities in general, and of the Latvian Republic in particular, for studying and applying successful experience of foreign countries in order to improve the activities of Ukrainian law enforcement agencies. Target of research. The purpose of the study is on the basis of analysis of theoretical foundations, legislative acts, to investigate the administrative and legal status of the national police of the Latvian Republic in general and some of its components in particular. Analysis of recent researches and publications. The following scientists analyze separate aspects of the question in their researches: O. Skakun, V. Kopeichikov, V. Averyanov, S. Kivalov, K. Volynka, D. Pavlov, Y. Bytyak, O. Bandurka, A. Gubanov, V. Pleshhkin, S. Gusarov, S. Bratkov, M. Gutsalyuk, V. Zhuravlev, M. Kaparyn, V. Zakharov, M. Litvinov, A. Manzhay, O. Marenin, S. Ovchynskyy, A. Osipenko, Y. Orlov, M. Perepelytsya, O. Pronevych and others. Article’s main body. By creating a new police model, Ukraine was guided by the relevant authorities of other European countries. Therefore, it is now relevant to analyze the police structures and their administrative and legal status of the Latvian Republic. It is important that this state can serve as a good example, since the historical past, including the constant subordination to other states, the form of government, the legal institutions and their purposes, the time of independence, the ethnic population and other important indicators almost completely coincide with the Ukrainian ones. The legal basis regulating the activities of the Latvian police and other bodies of state power is the Constitution of the Republic of Latvia, international treaties, laws and regulations, as well as decisions of the self-government bodies, if they do not contradict the legislation in force. For the effective performance of their tasks, the police authorities have their own competence, that is, the extent of the powers of their employees. The presence of competence in any law enforcement agency is a criterion for its separation from others by obligatory consolidation of specific rights and obligations in the legislation. Conclusions and prospects for the development. Created in 1991, Latvian police have a clear legal framework, which regulates their administrative and legal status. Due to this, knowing the legally established list of their functions, tasks, rights, duties and guarantees, police officers faithfully serve their state and people. Activities of the Latvian police may be considered successful in the international arena, so law enforcement system of Latvia and other advanced countries of Europe is an exemplary model of construction of internal organs to other countries around the world, including Ukraine.
