FINANCE AS AN OBJECT OF FINANCIAL REGULATION

Abstract
Problem setting. The article provided a description of finances as the object of financial legal regulation. It is emphasized that financial legal regulation focuses on streamlining relationships that are most important to society because it provided them through implementation of any functions of the state, the task of local communities. Objective reality is reflected in the rules of finance law through this mechanism. The most important at the present stage are social relations that objectively require government guarantees and ensure the state distinguishes a result of the totality of economic (financial) relations. Analysis of recent researches and publications. These relationships acquire the character of financial relationships. It is significant that the definition of finance had recourse a number of scientists (L. K. Voronova, A. A. Dmytryk, A. A. Nechay, O. A. Lukashev et al.). At the same time, it does not lose its relevance, due to the continuous development of economic relations in the country. Characteristic of object of finance as financial legal regulation is purpose of this article. Article’s main body. It is stablished that in the current financial and legal literature simultaneously using several terms: finance, state finance, public finance. Financial lawyers usually define this notion of finance and public finance, in different ways. Analysis of legal acts carried out on the basis of which the actual use of the terms «public finances», «of state finances», «public funds» both stated as identical. There is no distinction in the categories mentioned in legal acts, but it focuses on their material content. It notes that in determining the category of finance is necessary to proceed with its economic nature. Finances are a system of economic relations connected with systematic formation and public distribution of centralized and decentralized funds required for the functioning of state and local governments and other entities which recognized necessary by the state. Conclusions and prospects for the development. It is proved that the result of discussions concerning the category «Finances» must be regarded as defining the list of financial relationships that fall under the regime of financial legal regulation.
