SOME QUESTIONS OF A LEGAL NATURE AND TIMING OF THE JUDICIAL PROTECTION OF RIGHTS THROUGH THE APPLICATION OF CONSEQUENCES OF INVALIDITY OF THE TRANSACTION

Abstract
This article examines the problem of judicial application of the consequences of invalid transactions. Analyzes the relationship of the protective powers with a claim for invalidation of transactions. A collation of the limitation period for this requirement. Elucidated the essential characteristic features of the time and restitution claims. Analyzed the specifics of the presentation of the claim of the application of consequences of insignificant transactions. Proposed options to improve the existing legislation in the field commented.
