Abstract
The article is devoted to scientific sources of surety agreement. On the basis of Roman law and research of bail, the scientific works have been analyzed under which the relationship with the bail is considering. Scientific and theoretical basis of the study were scientific works of various scientists and encyclopedic information and legal literature. The part of works on the theory of Roman law was analyzed. The modern scientific sources of this institution, the judiciary, the international practice of bail were translated. Today’s demands of bail enforcement provisions require professional scientific researches, which should attract to the analysis not only the current national practice but the international experience and in particular the European Court, Council Directive etc.
