SPECIAL CHARACTERISTICS OF ELECTRONIC EVIDENCE IN PLANE OF COGNITIVE CONSONANCE

Abstract

The problems of the formation of the theory of signs of electronic evidence and their legal assessment in the plane of informatization of legal proceedings, judicial reform and the introduction of electronic means of proof are covered. Concepts are presented and analyzed, reflecting various approaches to understanding the essence of electronic evidence in the administrative process. The author proposes a classification system for signs of electronic evidence. It is concluded that the modern theory of evidence is in a state of transformation under the influence of the informatization of society, but at this stage in the development of society these are only the first steps of significant transformations. But due to a scientific understanding of the signs of electronic evidence, it will allow to fully use the legal nature of electronic evidence when considering and resolving administrative disputes, which will contribute to improving the level of protection of the rights and interests of participants in the administrative process. The problems of forming the theory of signs of electronic evidence and their legal estimation in the area of informatization of court proceedings, judicial reform and introduction of electronic evidence means are covered. Concepts representing different approaches to understanding the essence of evidence of electronic evidence in an administrative court process are presented and analyzed. Proposed author's system of evidence of electronic evidence as a specific means of proof. It is concluded that the modern theory of evidence is in a state of transformation under the influence of informatization of society, but at this stage of development of society - these are only the first steps of significant transformations. However, proper scientific understanding of the evidence of electronic evidence will allow the full use of the legal nature of electronic evidence in the consideration and resolution of administrative disputes and will promote an increase in the level of protection of rights and interests of participants in the administrative process.
