SPECIAL PROCEDURE FOR CRIMINAL PROCEEDINGS ON THE COURT OF JUSTICE OF THE CONSTITUTIONAL COURT UNDER THE DEPARTMENTAL INVESTIGATION

Abstract
The article deals with the theoretical study of the special procedure of criminal investigation of a pre-trial investigation in relation to a judge of the Constitutional Court of Ukraine. Analysis of legal sources on problematic issues concerning the implementation of the provisions of the CPC of Ukraine regard in the implementation of a special procedure for criminal proceedings concerning a judge of the Constitutional Court is under way. It is emphasized on legislative gaps, legal unregulations, inconsistencies, as well as conflicts on the procedural regulation of the commencement of such a pre-trial investigation, notification of suspicion, detention, the election of another preventive measure and the procedure for the appeal. Including the procedure for granting consent for a search, inspection of personal belongings and luggage, transport, residential or office premises, violation of secrecy of correspondence, telephone conversations, telegraph and other correspondence, the exercise of reason, removal from office and the use of other procedural measures and secret investigators (wanted) actions.
