Stability of Democracy and the Question of Banality of Judicial Evil – Judges with Impeccable Characters

Abstract
The purpose of the article is to analyze judicial attitudes in a changing legal and political environment and to investigate the reasons for loss or deprivation of “impeccable character” in judges – a trait that is fundamental to this profession. The author posits that the freedom and independence of the judiciary is among the key preconditions for a stable and effective democracy. She also argues that assigning the attribute of “impeccable character” to judges is not synonymous with their ability to think independently – a trait that should be intrinsic to a truly autonomous judge. In the context of “banality” of judicial evil, the author raises the issue of the unsuccessful vetting process that was applied to the Polish judiciary at the outset of the country’s political transformation of the 1990s.
