STATE SOVEREIGNTY AND ENVIRONMENTAL LAW

Abstract

It is trite that sovereign states are to refrain from interference in the domestic affairs of other states on the one hand and, but, on the other hand, the territorial limitation of a state empowers it to do as it pleases. In so far as international boundaries exist, the possibility that disputes may arises are obvious. Boundary disputes are engendered by the procurement of natural resources beyond a state’s border. The concept of state sovereignty is therefore designed to protect a state’s independence from and legal impermeability in relation to foreign powers on the one hand and the state’s exclusive jurisdiction and supremacy over its territory and inhabitants on the other. The status quo has seemed to be changed now. The sovereignty of states has been challenged by NGO’s (nongovernmental organizations) and multinationals. These nongovernmental organizations influences over foreign policy will have rendering them active in environmental endeavours. This will probably signalled the decline of state sovereignty.
