Subjects that provide and participate in the movement of metal through the customs border of Ukraine

Abstract
The article is devoted to the characteristic of the subjects that provide and partici- pate in the movement of metal through the customs border of Ukraine. The classifica- tion of such subjects is given in the article and based on criteria of vesting the sub- ject with state-powers. It is proved that the legal entities that are endowed with state authorities in matters related to the movement of metal through the customs border of Ukraine are: The Verkhovna Rada of Ukraine, the Cabinet of Ministers of Ukraine, Ministry of Economic Development and Trade of Ukraine, Ministry of Ecology and Natural Resources of Ukraine, Ministry of Finance of Ukraine, State Environmental Inspectorate of Ukraine, State Fiscal Service of Ukraine. The subjects of the relationships that do not have state authorities and take active part in the movement of metal through the customs border of Ukraine are: in a case of export of scrap metal — extremely specialized metallurgical processing enterpris- es; in a case of import — entities (business organizations and citizens of Ukraine, foreigners and persons without any citizenship who are registered as entrepreneurs provided the availability of own capacities for environmentally safe processing, met- allurgical processing of scrap metal or contracting with enterprises for processing, metallurgical processing of scrap metal on the territory of Ukraine); in a case of transit — legal entities and persons (restrictions are not set). The subjects of the relationships that do not have state authorities, but provide ser- vices related to the movement of metal through the customs border of Ukraine are: customs broker (services of declaration); carrier (transportation); temporary stor- age holder, the holder of a free customs zone of commercial type, the holder of cargo customs complex (services of storage).
