SUBSTANTIAL COMPONENT OF THE MUNICIPAL AND LEGAL RELATIONS: THEORETICAL ASPECT

Abstract
The article considers approaches to the definition of the main tenance municipal and legal relations developed in domestic legal science. While in pre-revolutionary, soviet and post-soviet legal literature the prevailing approach to the problem was to identify the terms «subject of municipal law» and «subject of municipal legal relations», in modern legal science the prevailing view is that the correlation of these categories does not imply the equivalence of these notions. The analysis developed in the theory of the right concepts concerning the subjective right and the subjective duty has allowed the author to define fundamental preconditions to a substantiation of the essence of the municipal and legal relations in view of specificity of the last. The article contains results of the author’s approach to the definition of essence of the investigated maintenance municipal and legal relationship, regularities of its development, a foundation of its theoretical and legal importance.
