Abstract
L.N. Boyko. The essence, structure and terms of ownership rights on agricultural land. The subject of the research are scientists approaches to defining the essence of the definition of "property"; aspects of the examination of the structure of property relations; economic conditions of the implementation of ownership of agricultural land. The purpose of work is to consider the nature, structure and terms of realization of the rights on land owned agricultural land in Ukraine. The study used scientific methods of ordering and generalization of scientific approaches of scientists and experts to the definition of the category of "property", composite system of property relations, consideration of the conditions of ownership rights on agricultural land in Ukraine. The results. The analysis found that there are two basic approaches to the interpretation of the definition of "property": representatives of the first approach, pay attention to the external signs of the property, while the majority of scientists property is defined as a system of social relations. Ownership of agricultural land will be complete only when the interrelationship of all its components and complete implementation of property relations. In other words, only when the landowners and land users would make economic sense to engage in agricultural production and make a profit on their capital (including land) is not less than in other areas of capital investment. The main prerequisite for economic implementation of private ownership of land in agriculture is a stable legal support; creating a favorable economic environment that would encourage owners to involve land in agricultural production and to obtain the corresponding income; implementation of a system of material incentives for landowners and land users for the rational use and protection of lands; optimal combination of economic freedom for the owners and land users and the number of severe restrictions of private ownership of land, which will be satisfied with the environmental safety requirements and form a favorable environment for human habitation. Scope of the results. These findings should be taken into account in the formation of public authorities agricultural policy to ensure the development of the rural sector hazyaystva.
