Abstract
The article defines the state of legality in the customs sphere, notes the significance of its observance in the implementation of customs. Theoretical and legal approaches to the definition of the essence of legality in a general sense, in the theory of law and, in particular, in customs law are analyzed and summarized. The essence of legality as a legal regime and the principle of state customs is determined.
