System of constitutional proceeding guarantees protection of personal data in criminal proceedings

Abstract
The effect of general constitutional guarantees in securing the legality of undercover investigative actions in the context of personal data protection is highlighted. In particular, the peculiarities of such procedural safeguards in the light of the person’s ability to develop freely as an individual, the presumption of innocence, the disclosure of information about the private life and life of their families and relatives, as well as the rights-privileges of certain categories of free occupations, are analyzed. The argumentation about the constituent elements of the due process of law in the course of carrying out undercover investigative actions from the point of view of respect for human rights, observance of the guarantees of adversarial process, standards of an independent and impartial court is provided.
