Tactical means of examination of traffic accident scene

Abstract

This article is devoted to the study of crime scene examination in cases of road accidents, put forward the author's position on the need for strict compliance with court investigator rules for the conduct of this examination, the analysis of tactical and forensic aspects of the examination of the scene during the Commission of a traffic accident and the development of guidelines for the investigation of crimes against road safety. Early in the investigation, there are two typical situations: a) the driver is known (he and the vehicle are on the scene; the driver fled with the car or without it, but his personality is established); b) the driver of an unknown (he fled the scene with the car, or left a stolen car). The most common is the first situation. For the second situation, when the driver of the car fled the scene, usually the most serious adverse effects in the form of causing of heavy harm to health or death of the victim. In order to establish the identity of the driver who caused a car accident, you need to adhere to existing tactics of carrying out of examination of the scene, with the participation of expert automotive equipment, when bump in the night, the next day to conduct a further inspection of the scene, in the presence to withdraw samples of rubber from skid marks. The legislator has defined the inspection of the scene article 237 of the Criminal procedural code of Ukraine «browse». In accordance with the provisions of this article the purpose of the inspection is to identify information regarding the circumstances of criminal offense and their fixation. The results of the inspection, the investigator prepares a report. Given the nature of the accident, investigators were not proficient in the skills of a qualified inspection of the accident scene. They clearly describe and record results of inspection, at the wrong level to apply scientific and technological means. The organization and tactics of examination of the crime scene, use methods in connection with a specific, method of making and the traces of the crime. In any case, strict compliance with the rules of criminalistics allows the investigator to obtain the most complete picture of the crime.
