To the problem of the institute of secret investigative (search) actions in the evidence right of Ukraine.

Abstract
The article analyzes the problems of the formation and development of the Institute of secret investigative actions under the Criminal Procedure Code of Ukraine, using their results in the proof. The issue of improving the state of ensuring human rights and freedoms during the conduct of appropriate actions is emphasized. In accordance with the requirements set out in the Judgments of the European Court of Human Rights in Criminal Procedure Code of Ukraine require more detailed regulation almost all secret investigative (search) actions except «special investigative experiment», «simulation of the crime situation», «location of the radio electronic device» and «use of confidential cooperation». The latter, together with such an event as «survey of publicly available places, housing or other property of the person», may be excluded from the system of investigative actions.
