TESTAMENTARY REFUSAL (LEGATE) UNDER THE LEGISLATION OF UKRAINE AND SOME EUROPEAN COUNTRIES

Abstract
The author’s conceptual provisions of the substitute of the testamentary refusal in civil law are considered in the article, including the notion and legal essence of the testamentary refusal, the legal status of heir, to which the testamentary refusal is assigned. Using the method of comparative analysis of national legislation and similar provisions of some foreign countries, the author proves that special testamentary orders must also include the testamentary burden, the appointment of testamentary executor, as well as the other orders of the testator.
