THE ANTI-CRISIS COLLECTIVE AGREEMENTS – TEMPORAL ISSUES

Abstract

The article refers to the temporal issues of anti-crisis collective agreements in labour law, which are reducing the employment’s conditions as a consequence of employer’s serious economic situation. Firstly, the moment of the beginning is analyzed; it brings a conclusion, that the first potential moment, when an agreement to suspend the collective labour agreement can enter into force, is the day of its registration. As for the other agreements – it is the matter of parties’ decision. Secondly, there are some issues on the maximum possible duration of the anti-crisis collective agreements. \e main problem is: is the maximum possible duration of the Art. No. 231a agreement a 3-old-year period, or is it the matter of parties’ independent decision. The axiological considerations make the first option more convincing. The last problem is the question, if the anti- -crisis collective agreements can be terminated. The answer is positive.<br/><br/>
