The application of mediation procedure in jurisdictional process: advantages and gaps of the draft Law of Ukraine "On mediation" (№ 3665 from 17.12.2015)

Abstract
The theoretical question of using the mediation procedures in the jurisdiction process of Ukraine on the basis of study an international experience and basic provisions adopted in the first reading of the draft Law of Ukraine "On mediation" and the gaps in the legal regulation of appointed institute in terms of compliance with the European standards on law enforcement and the specific national legislation are analyzed. It isanalyzed in the context of definite, a series of regulatory legal acts and it was provided the proposals for improving the current legislation that regulates in part the using of mediation procedures as an integral component of the jurisdictional process.
