The Constitutional Legal Status of the Member of the Seimas in the Doctrine of the Constitutional Court of the Republic of Lithuania

Abstract

Constitutional legal status of the member of Seimas in the doctrine of Constitutional Court of the Republic of Lithuania is analyzed in the article. In the doctrine of the Constitutional Law, the status of the member of Seimas is understood as a legal condition of the parliamentarian, regulating appearance of the mandate of the member, the beginning of origin of his authorisations and the grounds of their termination, the rights of the member of Seimas, including such rights, which are implemented together with other members of Seimas (the right of interpellation, the right of legislative initiative, the right to initiate an impeachment etc.) and duties, responsibilities, regime of habeas corpus as well as the guarantees of activities. Interdependent norms and principles, regulating legal status of the member of Seimas are noticed. Some aspects of the legal condition of the member of Seimas established in the Constitution (articles 55-63), in the Statute of Seimas (articles 1 –23), in the law on work of the members of Seimas, as well as such regulative acts as harmonisation of Private and Public Interests in the law on State Service, in the law on Operative Activities and beyond all peradventure, in the respective decisions of the Constitutional Court are discussed.
