The content and structure of subjective electoral law in Ukraine

Abstract

The article describes the content and structure of subjective electoral law in Ukraine. It is proved that electoral law is often used in legal sources in a subjective sense and is considered one of the most important citizen’s political rights of in the constitutional law doctrine. Under subjective electoral law, it is proposed to understand the right of citizens, which is enshrined in the constitution and guaranteed by the state, to elect to the representative bodies of public power or to be elected to these authorities. It is indicated that subjective electoral law in Ukraine consists of two of its subspecies: 1. Active suffrage is the right of able citizens of Ukraine, who on the day of voting has turned 18, to elect in the elections by voting for candidates to representative bodies of public authority. 2. Passive suffrage is the right of the citizens of Ukraine, which meet the requirements set by the legislation, to be elected to representative bodies of public authority by nominating their own candidature for participation in elections.
