Journal Title: Journal of Advanced Research in Social Sciences and Humanities - Year 2020, Vol 5, Issue 2
Abstract
Aim: This paper evaluates the level of awareness in Malaysia, Klang Valley’s community in terms of the division of inheritance of property management. In line with this study’s purpose, the researcher wants to assess the cause of the problem with the general public in managing their estates and property distribution types available in the Sharia, the faraid, wasiat, and hibah. Method: Primary data were gathered through semi-structured interviews that were used on four (4) estate management agencies in Malaysia, namely the Majlis Agama Islam Selangor (MAIS), As-Salihin Trustee Berhad, Amanah Raya Berhad (ARB) and Wasiyyah Shoppe Sdn. Bhd. Findings: Based on this study’s findings, knowledge of the community and the lack of understanding regarding inheritance of a property that occurred failed in carrying out the procedure of division of property through inheritance. A string of pending cases increases and indirectly withheld assets, contributing to problems as big as the global economy. This clearly showed that a mechanism needs to be exercised so that the community has some form of guidance in managing estates to avoid complication and confusion alongside ensuring social and economic relations in the future. Implications/Novel Contribution: The research is important because it offers a degree of public understanding and information about property management before death, similar to "grant" (donation) and facts in Malaysia.
